This paper analyzes the international legal framework on immigration in general and specifically as it relates to children, and examines its compatibility with the Convention on the Rights of the Child and other international norms. It considers alternatives to detention that are being, or could be, utilised by states, and concludes that immigration detention of children is only compatible with international law if certain criteria are met, particularly the criterion of`use only as a measure of last resort. It argues that there are almost no circumstances in which alternatives are unavailable to states, and that therefore it cannot be classified as a measure of last resort, rendering it incompatible with international law, other than in rare exceptional cases. |
