A German court ruled this month that the practice of detaining refugees and asylum seekers together with criminal offenders and remand prisoners in a regular prison is a violation of the EU returns directive.

On October 17th, the provincial court of Munich released an Eritrean refugee who was due to be deported to Italy.

IDC member JRS Germany, Munich office, has helped to submit 35 similar cases to court. In one of these the highest German Civil Court ordered the provisional release of a detainee.
